Notice Pursuant to Section 115 Land Transfer Act 2017

The applicant described below has applied under section 115 of the Land Transfer Act 2017 for the removal of a Right to Drain Sewage easement in the Canterbury Land Registration District. The applicant claims the right to drain sewage easement is redundant by reason of the circumstances set out below.

If no objections have been received before Monday, 5 August 2024 the Records of Title will be updated to record the easement as redundant.

Easement: Right to Drain Sewage easement over part Lot 1 DP 5067 in Record of Title CB317/75 (“burdened land”) owned by 49 Browns Rd Limited, for the benefit of Lot 1 DP 221433 in Record of Title CB3A/327 owned by Brooke Elizabeth White, Shannon Joseph Bateup and R B A Trustees (2010) Limited, and for the benefit of Lot 2 DP 22133 in Record of Title CB3A/328 owned by John Edward Albert Drayton, Jean Drayton and Philip Graham Collins.

Circumstances: The easement has been separated from the burdened land by the subdivision of DP 22133.
