Pursuant to Regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Deputy Chief Executive Fisheries Management at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 7) 2010.
(2) This notice shall come into effect on 12 August 2010.
2. Interpretation-In this notice:
(a) "customary food-gathering" has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1999.
(b) "Tangata Tiaki/Kaitiaki" means the person or persons appointed under Regulation 21 of the Fisheries (South Island Customary Fishing) Regulations 1999 for the management of customary food-gathering within a mataitai reserve.
(c) "mataitai reserve" means a traditional fishing-ground over part of the Mataura River, Southland.
The mataitai reserve encompasses the waters
of the Mataura River within:
(i) the northern boundary, being a line in an easterly direction across the Mataura River (from a point at 46°10.45'S and 168°53.67'E on the eastern bank to a point at 46°10.45'S and 168°53.87'E on the western bank) about 500 metres upstream of the Mataura tannery; and
(ii) the southern boundary, being a line in a westerly direction across the Mataura River (from a point at 46°13.96'S and 168°50.97'E
on the western bank to a point 46°13.96'S and 168°51.03'E on the eastern bank) at a bend
in the Mataura River about 1 kilometre downstream of Shanks Road.
3. Nomination of Tangata Tiaki/Kaitiaki-The Hokonui Runanga, representing the whanau and hapu of Ngai Tahu Whanui holding manawhenua manamoana over the mataitai reserve (as represented by Te Runanga o Ngai Tahu), has nominated Rewi Whakariri Walter Anglem as a Tangata Tiaki/Kaitiaki for managing customary food-gathering within the mataitai reserve.
4. Appointment of Tangata Tiaki/Kaitiaki-On 19 July 2010, the Minister of Fisheries and Aquaculture appointed, under Regulation 22(3) of the Fisheries (South Island Customary Fishing) Regulations 1999, Rewi Whakariri Walter Anglem as a Tangata Tiaki/Kaitiaki for managing customary food-gathering within the mataitai reserve for
a further five-year term. The appointment will expire on
11 August 2015.
5. Power to authorise taking of fisheries resources for customary food-gathering-Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food-gathering purposes from within the whole or any part of the mataitai reserve for which they have been appointed as a Tangata Tiaki/Kaitiaki. No customary food-gathering of fisheries resources may take place in the mataitai reserve without an authorisation from a Tangata Tiaki/Kaitiaki.
