Electricity Governance Regulations (Exemption No. 35 (Transpower New Zealand Limited)) Exemption Confirmation Notice 2006

Pursuant to Regulation 194 (5) (d) of the Electricity Governance Regulations 2003 (“Regulations”), the Electricity Commission gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 35 (Transpower New Zealand Limited)) Exemption Confirmation Notice 2006.
(2) In this notice, the Electricity Governance Regulations (Exemption No. 35 (Transpower New Zealand Limited)) Exemption Notice 20061 is called the “principal notice”.
(3) This notice comes into force on the day after the date on which it is notified in the New Zealand Gazette.
2. Confirmation of principal notice—(1) The principal notice was granted under urgency in accordance with Regulation 194 (4) of the Regulations, to provide an exemption from the requirement to comply with Rule
11.5.2 of Section IV of Part C of the Electricity Governance Rules 2003.
(2) The principal notice is confirmed.
3. Reasons for confirmation—The reason for this confirmation is to continue the removal of any disincentive on Transpower to offering:
(a) the HVDC runback capability; and
(b) the consequential increase in south transfer capability through the BPE-HAY circuits.
