Exemptions From Charter and Profile Requirements

Under sections 159B (2), 159N (4) and 159Y (3) of the Education Act 1989, the Minister of Education and
the Tertiary Education Commission (TEC) give the following notice.

1. This notice may be cited as the Education (Exemptions from Charter and Profile Requirements) Notice 2005.
2. This notice applies from the date of its publication.
Introduction
All organisations that seek or receive funding from the TEC must have an approved charter and profile unless exempt from the requirement to have a charter and profile.
Providers of Tertiary Education-Related Services
Organisations are defined under section 159B of the Education Act 1989.
Before a body is eligible to have a charter considered for approval by the Minister or to be exempted from the requirement to have a charter, the body must first be identified by the Minister as an organisation for the
purposes of Part 13A of the Education Act 1989, under section 159B of the Education Act 1989.
For the purposes of Part 13A of the Education Act 1989,
the Associate Minister of Education (Tertiary Education) identifies the following individual bodies that provide tertiary education-related services as organisations within the definition of section 159B (1) (c) of the Education Act 1989.
Identification of these bodies expires on 31 December 2005:
Auckland Regional Migrant Settlement Services Centre.
New Zealand Council of Trade Unions.
Youth Skills New Zealand.
For the purposes of Part 13A of the Education Act 1989, the Associate Minister of Education (Tertiary Education) identifies the following type of body that provides tertiary education-related services as an organisation within the definition of section 159B (1) (c) of the Education Act 1989 for so long as they receive workplace literacy funding from the TEC:
Employers that only receive workplace literacy funding from the TEC.
Exemptions From Charter and Profile Requirements
for 2005
The Minister exempts the following tertiary education organisations (TEOs) receiving TEC funding from 2005 tertiary charter requirements.
The TEC similarly exempts these same TEOs from 2005 profile requirements:
Adult Learning Services Limited.
Adult Reading Assistance Scheme (Christchurch) Incorporated.
Affirming Women.
Anthony Gibbs.
Auckland Somali Association.
Auckland Regional Migrant Settlement Services Centre.
Canterbury Somali Association.
City of Manukau Education Trust.
Eduserve.
Ethiopian Community of Auckland.
Finlayson Park School.
Marie Cheetham.
Niue Development.
New Zealand Council of Trade Unions.
NZ Education Services Limited.
Te Akamataanga Ou.
The Correspondence School.
Tuwharetoa Maori Trust Board.
Upuamata.
Vaevaemanava Tongan Community Trust.
Victory Primary School.
Warren Shepard.
Whangaruru School.
Youth Skills New Zealand.
Exemptions From Charter and Profile Requirements for Employers Receiving Only Workplace Literacy Funding From TEC
The Minister exempts the following type of TEOs receiving TEC funding from charter requirements for so long as they receive workplace literacy funding from the TEC.
The TEC similarly exempts these same TEOs from profile requirements for so long as they receive workplace literacy funding from the TEC:
Employers that only receive workplace literacy funding from the TEC.
