Notice of Recognition of Documents Under the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999

Pursuant to Regulation 22 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999, I, Mark Donaghue, in exercise of powers delegated to me by WorkSafe New Zealand, hereby give notice of recognition of the documents listed below submitted by Todd Energy Limited.

  1. Letter of endorsement from Sentinel Inspection Services Limited dated 10 October 2023,
  2. Sentinel Inspection Services Limited ISO 17020 certificate of accreditation (128 Issue 17) issued by IANZ 17 July 2023,
  3. Current Todd Energy ISO 9001, quality management system certificate of accreditation (NZ20/81841296.00) issued by SGS 6 April 2021,
  4. Current Todd Energy Pressure Equipment Integrity Management Standard (TE-6530-TECD721708 Rev 3),
  5. Current Risk Based Inspection Guideline (TE-4000-TECD721680 Rev 1), and
  6. Todd Energy pressure equipment list under RBI program.

This notice also serves purpose to withdraw New Zealand Gazette, 6 May 2021, Notice No. 2021-au1639 regarding historic recognition of the risk-based inspection programmes of the Todd Energy Limited sites under the specified regulations herein.

The submission indicates that this equipment would be managed in a manner consistent with the requirements of the Health and Safety in Employment (Pressure Equipment, Cranes and Passenger Ropeways) Regulations 1999 (PECPR).

Accordingly, I advise that recognition of the inspection programme, as set out in the above detailed documentation, is granted under Regulation 22 of the PECPR Regulations.

This recognition is subject to the following conditions:

  1. Recognition applies only to pressure equipment specified in the documentation detailed within the submission.
  2. Inspection periods shall not exceed the maximum permitted by 4.4.4.1(b) “Extended Interval” of AS/NZS 3788.
  3. Todd Energy Limited’s nominated Recognised Inspection Body shall determine the frequency and timing of the attendance of its equipment inspectors for the purpose of reviewing, approving and auditing the implementation of the ITP and for the inspection and certification of equipment.
  4. Todd Energy Limited shall advise its nominated Recognised Inspection Body of any changes to its equipment or process that may affect safety, equipment life or the frequency or type of inspection applied. Todd Energy Limited shall, in conjunction with its nominated Recognised Inspection Body, review actual or proposed changes to its equipment or process in order to establish any potential impact on safety and equipment inspection.
  5. Todd Energy Limited shall advise its nominated Recognised Inspection Body of any changes to, or affecting, Todd Energy Limited’s engineering personnel.
  6. Todd Energy Limited shall review its quality management system immediately, and regularly, and update it to accommodate any changes necessary following the granting of this recognition.
  7. This recognition shall remain in force for a period of five years from the date of this letter, provided all its conditions continue to be satisfied and unless cancelled in writing.
  8. Application for continued recognition will be required on or before 22 November 2028.
  9. This recognition may be withdrawn should the services of Sentinel Inspection Services Limited (its nominated Recognised Inspection Body) be discontinued or, if there is any significant change to the equipment or process.
