Notice Pursuant to Section 114 of the Land Transfer Act 2017

The applicants described below have applied under section 114 of the Land Transfer Act 2017 for the removal of an easement at Nelson. The applicants claim the easement is redundant by reason of the circumstances set out below.

I intend to remove the easement on 8 September 2022 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 8 September 2022.

Circumstances: The water right easement is extinguished due to an event specified in the document creating it, being that the easement was not assignable by the Grantee but personal to it so long as the Grantee occupied and worked the freezing works on the land. The Grantee transferred all their estate and interest in the land, and the Grantee ceases to occupy the land with the benefit of the easement.
