CORNWALL PARK TRUST BOARD

Notice of Application for Approval of a Charitable Trust Scheme

Take notice that on Wednesday 3 August 2022 an application for orders approving a scheme prepared under Part 3 of the Charitable Trusts Act 1957 was filed in the High Court at Auckland in relation to the CORNWALL PARK TRUST BOARD, a charitable trust registered under the Charities Act 2005.

The CORNWALL PARK TRUST BOARD relates to the Cornwall Park Trust, which holds Cornwall Park in Auckland, as well as related assets.

The application is to be heard before the High Court at Auckland on Wednesday 19 October 2022 at 10.00am.

Any person who wants to oppose the scheme must, not less than seven clear days before the hearing date, give written notice of their intention to do so to:

  1. the Registrar of the High Court at Auckland;
  2. the CORNWALL PARK TRUST BOARD; and
  3. the Attorney-General.

The purpose of the Cornwall Park Trust was to hold land upon trust as a place of public recreation and enjoyment for the people of New Zealand. The relevant trust documents do not expressly provide the CORNWALL PARK TRUST BOARD with the power to indemnify the Trustees, or to purchase insurance against potential liability, from the Trust’s property. The scheme proposes to amend the relevant trust documents to give the CORNWALL PARK TRUST BOARD the ability to indemnify the trustees, or to purchase insurance against potential liability, from the Trust’s property.

The Applicant is the CORNWALL PARK TRUST BOARD, whose address for service is at the offices of DLA Piper New Zealand, 15 Customs Street West, Auckland.
