Notice of Direction for the Disposition of the Surplus Assets of a Dissolved Incorporated Society

MOUNTAIN VIEW PACIFIC ISLANDERS (SAMOAN) CHURCH INCORPORATED (Incorporated Society Number: 1133777) (“Society”) also known as Alia-O-Manu Presbyterian Samoa Christian Church, pursuant to section 27(1) of the Incorporated Societies Act 1908 (“Act”).

Take notice that the Registrar of Incorporated Societies (“Registrar”) has, following the application of the Society under section 27 of the Act for surplus assets of the Society which was dissolved by the Registrar on 3 March 2016, directs that:

1. the Society’s surplus assets being all funds in the Society’s bank account which has been transferred to the Trust Account of Thorne, Thorne, White & Clark-Walker (the Society’s solicitors) in the sum of approximately $133,222.89, and any interest earned on these funds be vested in equal shares in:
1. The Orakei Presbyterian Church operating under The Presbyterian Church of Aotearoa New Zealand (CC33597) a registered charity with Charity Services, bank account number 12-3073-0107806-00; and
2. Owairaka Presbyterian Church (also known as the Pacific Islanders Church at Owairaka), bank account number 02-0176-0244690-00;

for the specific purpose of completing renovations to their respective church buildings.

Before these funds are transferred to the foregoing bank accounts, the Registrar directs that the Society:

1. Pay all debts, costs and liabilities in relation to the dissolution of the Society; and
2. Pay all reasonable legal fees of the Society’s solicitors, Thorne, Thorne, White & Clark-Walker for attendances pertaining to these directions.

These directions shall become final on 10 January 2022. No appeal shall lie unless notice thereof is delivered before that date.
