NOELINE CLARK FOUNDATION

Application for Approval of a Scheme to Vary Trust Deed

Pursuant to Part III of the Charitable Trusts Act 1957

Notice is hereby given that the Trustees of the NOELINE CLARK FOUNDATION, a charitable trust incorporated under the Charitable Trusts Act 1957, have filed an application in the Christchurch High Court for approval of a scheme varying the terms of the NOELINE CLARK FOUNDATION Trust Deed.

The Trust Deed outlines the charitable objects of the NOELINE CLARK FOUNDATION. The purpose of the NOELINE CLARK FOUNDATION is to provide scholarship(s) to Burnside High School students to attend the University of Canterbury. Under the scheme, the Trustees of the NOELINE CLARK FOUNDATION apply to broaden the scope of those charitable objects and make certain amendments to the Trust Deed, such that the objects of the Trust can be achieved in light of introduction of policy by the Government providing for one year of free tertiary study. The scheme also provides for modernised language in the Trust Deed and that the governance of the NOELINE CLARK FOUNDATION is more practicable and expedient moving forward.

Copies of the application, the proposed scheme and the report of the Attorney-General may be inspected at the office of the Registrar of the High Court at Christchurch or the offices of Wynn Williams, solicitors for the applicant, at Level 5, Wynn Williams House, 47 Hereford Street, Christchurch.

The application is set down for a hearing in the High Court at Christchurch on 21 September 2020 at 11.45am. Any person desiring to oppose the scheme is required to give notice in writing of his or her intention to do so to the Registrar of the High Court in Christchurch, the applicant, through the office of Wynn Williams) and the Attorney-General not less than seven clear days before 21 September 2020.
