TE MATA PARK TRUST BOARD

Notice of Application for Approval of a Scheme Under Part III of the Charitable Trusts Act 1957

Notice is hereby given that the trustees of the TE MATA PARK TRUST BOARD (“Trust”) have filed an application for approval of a scheme varying the terms of the Declaration of Trust under which the Board was settled.

Under this scheme, the provisions of the Declaration of Trust shall be varied as follows:

  1. To provide for both male and female descendants of the Chambers family to be the Chambers family representatives on the Board;
  2. For the annual balance date to be changed to 30 June in each year;
  3. That the month for the annual meeting be changed to November;
  4. To provide that one person of mana whenua descent to be appointed by Ngati Kahungunu Iwi Incorporated on the recommendation of a Committee established by the Board. The appointment to be for a three year term.

Copies of the scheme and report of the Attorney-General thereon may be inspected, for free of charge, at the office of the Registrar of the High Court at Napier, or at the offices of S. J. Scannell & Co. Solicitors, 122 Queen Street East, Hastings.

The application has been set down for hearing in the High Court at Napier on Monday 17 February 2020 at 9.30am.

Any person desiring to oppose the scheme is required to give notice of his or her intention to do so to the Registrar of the High Court at Napier and to the trustees of the TE MATA PARK TRUST BOARD (c/- S. J. Scannell & Co.) and the Attorney-General not less than seven clear days before the above-mentioned date.
